Refund & Cancellation

Policy for AI product deployments and custom service engagements.

Important context: BiltIQ AI provides on-premise AI products and custom service engagements — not SaaS subscriptions. Our pricing is project-based, not per-user or per-month. This policy reflects that model.

1. Product Deployments

ATC Product Suite

  • Before work begins: Full refund of any advance payment, processed within 15 business days
  • During deployment (hardware configuration, software installation, data ingestion): Cancellation charge proportional to work completed. Remaining advance refunded within 15 business days
  • 14-day acceptance period: After deployment completion, you have 14 days to verify the product performs as specified in the SOW. If it fundamentally does not meet specifications, we will either resolve the issue or refund the deployment fee
  • After acceptance: Deployed products are on your infrastructure and under your control. No recurring fees for the product itself. Maintenance agreements are separate and can be cancelled per their terms

All product deployment fees are governed by the agreed quotation or Statement of Work (SOW).

2. Custom Service Engagements

  • Custom service engagements are governed by individual Statements of Work (SOW)
  • Payment milestones and cancellation terms are defined in each SOW
  • In general, work completed up to the point of cancellation is billable
  • You own all deliverables (source code, model weights, configurations) for work completed and paid
  • Advance payments for work not yet started are refundable within 15 business days of cancellation notice

3. AI as a Service (AaaS)

  • AaaS subscriptions are billed monthly or annually as per the agreed plan
  • Monthly subscriptions can be cancelled with 30 days' written notice
  • Annual subscriptions can be cancelled with 60 days' written notice; refunds are prorated for unused months
  • The deployed infrastructure and any fine-tuned models remain on your premises after cancellation

4. Consultation Fees

Initial architecture consultations (30 minutes) are free of charge with no obligation. If a paid consulting engagement is agreed upon, cancellation with less than 24 hours' notice may result in a charge for the scheduled time.

5. Hardware Procurement

If BiltIQ AI assists with GPU server procurement on your behalf:

  • Hardware purchases are governed by the hardware vendor's return/refund policy
  • BiltIQ AI is not responsible for hardware refunds — these are handled directly with the hardware vendor
  • Our consulting/configuration fees for hardware setup are non-refundable once the work is completed

6. Refund Process

  • Send refund requests to [email protected] with your project reference number, invoice details, and reason for the request
  • Acknowledgment: Within 3 business days of receiving your request
  • Review & decision: Within 7 business days of acknowledgment
  • Refund processing: Within 15 business days of approval, via the original payment method (NEFT/RTGS/cheque)
  • GST refund: If applicable, processed as per prevailing GST regulations. Credit notes issued within the same tax period where possible
  • Partial refunds: Where a partial refund is applicable, we will provide a detailed breakdown of work completed vs. remaining scope

7. Dispute Resolution

If you are dissatisfied with our products or services, we encourage you to contact us first at [email protected]. We will make a good-faith effort to resolve any issue. If a resolution cannot be reached, disputes will be governed by the Terms of Service and subject to the jurisdiction of courts in Jamshedpur, Jharkhand, India.

8. Force Majeure & Service Disruption

BiltIQ AI shall not be liable for delays or failure to perform obligations due to events beyond reasonable control, including natural disasters, government actions, power outages, internet service failures, or pandemics. In such cases:

  • We will notify you promptly of the disruption and its expected duration
  • Obligations affected by force majeure will be suspended for the duration of the event
  • If the disruption exceeds 60 days, either party may cancel the engagement with a prorated refund for undelivered work

Note on on-premise deployments: Because our AI systems run on your infrastructure, service disruptions on our end do not affect the availability of already-deployed products. Your AI stack continues operating independently.

9. Intellectual Property on Cancellation

  • For work completed and paid, you retain full ownership of all deliverables — source code, model weights, configurations, documentation, and any fine-tuned models
  • BiltIQ AI retains no copies of your custom deliverables after project completion and handoff
  • ATC product licenses for deployed software remain valid and perpetual for paid deployments, even after cancellation of maintenance agreements
  • Proprietary BiltIQ AI platform code (underlying ATC product engines) remains the intellectual property of Aarna Tech Consultants Private Limited

10. Governing Law

This refund and cancellation policy is governed by the laws of India. Any disputes arising from or related to this policy shall be subject to the exclusive jurisdiction of the courts in Jamshedpur, Jharkhand, India.

This policy should be read in conjunction with our Terms of Service and Privacy Policy. In case of conflict between this policy and a signed Statement of Work (SOW), the SOW terms shall prevail.
